1. Purpose
These Terms and Conditions of Use and Sale (hereinafter referred to as the “Terms”) govern the access, installation, and use of the WASPL application (hereinafter the “Application”), developed and operated by Wiquid – Jean-Philippe Rivière, as a digital assessment service for educational purposes.
WASPL is an open-source web application designed to be installed on the client’s own infrastructure (institution, training center, or individual teacher). It enables the creation, administration, and analysis of digital assessments.
WASPL is intended for:
- Individual teachers and trainers, who may use it free of charge for personal and non-commercial use;
- Educational institutions or training organizations, for whom usage is subject to a paid institutional license.
These Terms apply to any installation, use, or distribution of the Application, whether deployed locally or in a private or public cloud environment.
2. Access to the Application
WASPL is a web application accessible via browser, once installed on the client’s infrastructure, at a URL defined by the client (e.g.: https://evaluation.my-school.org/eval).
Access to the Application may be restricted to authorized users with named accounts, according to the authentication mechanisms implemented by the client or system administrator.
The publisher, Wiquid – Jean-Philippe Rivière, does not manage access, hosting, or maintenance of the deployed instance, except under a separate support or assistance agreement.
It is the client’s responsibility to ensure the security, availability, and confidentiality of their WASPL installation, including:
- Hosting and exposure of the service on the internet or a local network,
- User rights and permissions management,
- Backup and update procedures.
3. Features
WASPL notably offers:
- Creation and management of interactive tests,
- Editing of pedagogical interactions (multiple choice, matching, hotspot, etc.),
- Tracking and analysis of student results,
- Collaboration between educators (resource sharing),
- Export and import of assessment content.
4. Terms of Sale
4.1 Pricing
WASPL is free of charge for individual users, i.e., teachers or trainers using the platform independently to design, manage, or deliver assessments in the context of their own teaching.
However, WASPL requires a paid license for institutions, such as:
- Schools, universities, or continuing education institutions,
- Public or private organizations using the platform for collective or institutional purposes,
- Any entity integrating WASPL into a shared, interconnected, or commercial training environment.
Subscription terms, scope of usage rights, and pricing are available upon request or at [link to pricing/contact page].
The publisher reserves the right to reclassify individual usage as institutional if usage patterns justify it (shared access, high volume, multi-user management, etc.).
4.2 Payment Methods
Payment may be made by credit card, bank transfer, or any other accepted method. Invoices are issued automatically.
4.3 Refunds
No refunds are issued after subscription, except in cases of major technical failure unresolved within 30 days.
5. Intellectual Property
WASPL is protected under intellectual property law. All components (code, interface, documentation, brand, logo) are the exclusive property of the publisher or its partners. Any unauthorized reproduction, distribution, or exploitation is prohibited.
All pedagogical content created by users (tests, interactions, media) remains their property.
6. Use and Responsibility
The publisher provides the WASPL application as source code or executable package. Its correct operation depends on the client’s technical environment, notably the server infrastructure, database system, and containerization solution, if used (e.g., Docker).
The client is solely responsible for:
- Installing, configuring, and deploying WASPL,
- Managing users, hosted data, and backups,
- Implementing applicable security protocols (authentication, firewall, encryption, etc.),
- Complying with legal obligations regarding processed data.
The publisher cannot be held liable for any malfunction, data loss, or security breach resulting from:
- Incorrect installation,
- Faulty or unsuitable infrastructure,
- Any unauthorized modification of the source code.
7. Maintenance and Updates
The publisher regularly provides corrective or feature updates for the application. It is the client’s responsibility to apply these updates to their environment, either independently or within the framework of a support agreement with Wiquid.
Without a support contract, the publisher does not provide technical maintenance or direct assistance for third-party installations.
8. Data Protection
Since the client is responsible for their own infrastructure, they are considered the data controller within the meaning of the GDPR.
The publisher does not collect or process any data hosted locally or in the client’s environment. It is therefore the client’s responsibility to:
- Define the conditions for processing users’ personal data (students, teachers, etc.),
- Ensure compliance with the GDPR,
- Implement an adequate privacy policy.
9. Duration and Termination
These Terms remain in effect as long as the user continues to use the service.
The user may discontinue use at any time. The publisher reserves the right to suspend access in the event of a breach of these Terms, with or without notice depending on the severity of the breach.
10. Changes to the Terms
The publisher reserves the right to modify these Terms at any time. Any modification takes effect immediately upon publication on the website or within the application.
11. Open Source License – AGPLv3
The WASPL application is distributed under the AGPLv3 free software license (Affero General Public License version 3).
This means that:
- The client is free to use, copy, modify, and redistribute the source code of WASPL, including to third parties, provided the license terms are respected.
- Any modification or derivative used to provide an online service (including via network access) must also be made available under AGPLv3, with its source code accessible.
- It is prohibited to relicense any part of the application under an incompatible license.

Any institutional user or developer integrating WASPL into a broader solution must ensure their architectural choices comply with the AGPLv3.
12. Governing Law and Disputes
These Terms are governed by French law.
Any dispute will be subject to the exclusive jurisdiction of the courts of Toulouse, unless otherwise required by mandatory legal provisions.
